New Mexico Cannabis Laws

Medical & Recreational Marijuana

Medical marijuana businesses became legal in 2007. However, recreational (adult-use) marijuana businesses are currently illegal in the state.

The New Mexico Department of Health is in charge of the state’s medical marijuana program and issuance of the associated licenses. However, the county and city where the business will be located may also determine whether you can start a business within their borders or not.

See the Resources section below for additional info.

CBD & Hemp

The New Mexico Department of Agriculture is responsible for overseeing and issuing hemp cultivation licenses, while the New Mexico Environment Department deals with processing and manufacturing of “consumable hemp” products. There are no specific guidelines or required licenses for retail stores
to sell CBD products, but that doesn’t mean you can do anything you
want. The county and city where the business will be located may
determine whether you can open and operate a CBD or hemp business within
their borders or not. You’ll need to look up and verify those details
yourself or with our help via a Starter Package
